China’s revised Anti-Espionage Law came into force on the 1st of July 2023. Among its key changes include a significantly expanded scope of “espionage activity” to cover illegal collection or provision of “documents, data, materials or items related to national security or interests”, as well as enhanced powers from the authorities to enforce the law’s provisions. Coupled with recent anti-espionage cases involving foreign companies, this has raised concerns among the foreign business community who are keen to limit their exposure to the revised law.
Furthermore, the revised law introduces a notable degree of overlap with existing data laws, particularly where there is a cross-border dimension involved. This has resulted in an increasingly complex information environment, creating new implications for the way multinational companies (MNCs) operating in China should classify and manage sensitive information.
