In early 2023, the new EU system for patents will finally be launched. With a Unitary Patent Court comes the possibility of applying for a European Unitary Patent (UP) with coverage in most of the EU-member states. This will lead to increased trade opportunities for patented products and services, and the calibre for European patents will increase.
The European Unitary Patent also implies that new patents will be validated in each member country, leading to increased competitor monitoring. Furthermore, the new Unitary Patent Court will meet several challenges when facing a new system with inexperienced local courts and new Judges.
