Launch of the soft opening period to refile marks in Myanmar

Today, the Ministry of Commerce of Myanmar has issued its notification no. 63/2020 dated 28 August 2020 announcing the launch date of the soft-opening period for refiling trade marks. We are delighted to inform that the soft-opening period will start on Thursday 1 October 2020.

The refiling requirements, depending on whether the mark to refile was recorded or used in Myanmar, are as follows:

Recorded Declaration of Ownerships (DOO)

Evidence of actual use of the mark in Myanmar

3.

Published Cautionary notice

Evidence of promotional activities featuring the mark

Tax receipt showing use of the mark

5.

Evidence of assignment or name change if the applicant is different from the one mentioned in the DOO

Any other documents showing any use of the mark

6.

Evidence of use of the mark in Myanmar

 

7.

Evidence of promotional activities featuring the mark

 

8.

Tax receipt showing use of the mark

 

9.

Any other documents showing any use of the mark

 

 

Note: Documents 5 to 9 in the above table are not compulsory.
 
Marks which will be re-applied for additional or other goods/services than those for which they are already registered, the additional goods/services will not be accepted by the Registrar. Trade marks that don’t qualify for refiling during the soft opening period will only be able to be filed after the soft opening period.
