Providing a risk assessment for different corporate structures and locations for manufacturing in China
Our client wanted to establish a new production line in China. As their trade secrets were central to their competitive advantage they needed to manage leakage risks. They asked us to provide an assessment of the risks related to different legal set-up options within different regions.
We analysed the different locations and corporate structures using expert insights and diverse data sources assessing key trade secret risk factors including: access to information, likelihood of leakage, legal relationships with stakeholders, and enforceability.
In-house counsel was given a data driven and structured assessment of various risk levels. This enabled the business to make an informed decision on legal structure and specific factory location. This helped the client to stay in control of their trade secrets and subsequently their competitive advantage.
