特斯拉就特舒拉商标异议成功，国知局决定特舒拉商标不予注册

异议人特斯拉（上海）有限公司对被异议人广州睿捷汽车用品有限公司申请的第53436164号“特舒拉”商标提出异议，认为其存在使消费者混淆误认等不予注册情形。国知局经审理认为，“特舒拉”商标与异议人在先注册并使用的“特斯拉”商标使用的商品均为第12类“电动运载工具、汽车两侧脚踏板”等商品，其在功能、用途等方面基本相同，属于相同或类似的商品。此外，“特舒拉”与“特斯拉” 在文字构成和呼叫等方面也相近，构成近似商标。基于被异议商标与异议人商标已构成使用于同一种或类似商品上的近似商标，并存使用易导致消费者混淆误认，国知局最终做出对第53436164号“特舒拉”商标不予注册的决定。

The CNIPA Upholds Tesla’s Opposition to Registration of ‘Teshula’ Trademark

Tesla (Shanghai) Co., Ltd., no stranger to trademark disputes in China, recently successfully opposed Guangzhou Ruijie Automotive Accessories Co., Ltd’s application to register the trademark ‘Teshula’, No. 53436164. After a hearing, the CNIPA upheld Tesla’s opposition on the grounds that the ‘Teshula’ mark was similar to the previously registered ‘Tesla’ mark and being used in relation to goods similar to those in respect of which the ‘Tesla’ mark had been registered. As a result, use of the ‘Teshula’ mark would be likely to confuse or mislead consumers.

国家知识产权局举办“知识产权这十年”专题新闻发布会，并就有关问题答记者问。会上，国家知识产权局副局长胡文辉对近十年我国知识产权工作的发展状况作出总结，主要包括：知识产权法律制度完善、保护力度增强，知识产权保护社会满意度提高；知识产权有力引导创新创造，2012年至2021年，国家知识产权局累计授权发明专利395.3万件，年均增长13.8%，累计注册商标3556.3万件，年均增长25.5%；知识产权加速促进经济社会发展，知识产权使用费进出口增长明显，2012年至2021年，我国知识产权使用费进出口总额累计2.19万亿元，年均增长13.7%，其中出口年均增长31.2%，超过进口增速近20个百分点；知识产权服务对外开放深化，成功推动世界知识产权组织在中国设立办事处。此外，公共服务司司长王培章表示，国家知识产权局在减费降税、降低创新创业成本工作上取得成效，十年来共累计减免专利、商标收费总额达1262.8亿元。

CNIPA Press Conference on Chinese Intellectual Property Development in the Past Decade

CNIPA recently held a press conference on the theme of “Chinese Intellectual Property Development in the Past Decade” and replied to relevant questions of reporters. At the press conference, Hu Wenhui, the deputy director of CNIPA, summarized the achievements and developments that have taken place in China’s intellectual property system in the past decade.
First, the IP legal system has been improved generally, IP protection has been strengthened, and social satisfaction with intellectual property protection has increased. Second, IP has become more powerful in stimulating innovation and creation and the quality of IP rights has improved. From 2012 to 2021, CNIPA granted 3.953 million invention patents, with an average annual growth of 13.8%; and 35.563 million registered trade marks, with an average annual growth of 25.5%. Third, IP rights have increasingly supported both economic and social development. Royalties from the import and export of IP have increased significantly. From 2012 to 2021, China's total royalties from the import and export of IP amounted to CNY 2.19 trillion (approx. US$ 303 billion), with an average annual growth of 13.7%. The average annual growth of exports was 31.2%, exceeding the growth rate of imports by nearly 20%. Finally, international cooperation in the field of IP has deepened, with the establishment of a World Intellectual Property Organization in China.
The Director of the Department of Public Services, Wang Peizhang, noted that CNIPA has made achievements in reducing fees, taxes and costs of innovation and entrepreneurship. Over the past decade, the total amount of patent and trademark fees reduction has reached CNY 126.28 billion (approx. US$ 17.48 billion).

天津发行首单知识产权资产支持票据，发行金额1亿元

天津市第一支知识产权证券化产品——“天银渤化—滨海新区知识产权第一期定向资产支持票据（科创票据）”成功发行，发行金额为1亿元。该产品由天津银行、渤化集团知识产权运营中心、智慧财富牵头，东疆租赁企业金值（中国）融资租赁有限公司发起，并得到了天津市金融局、知识产权局以及滨海新区知识产权局的支持和指导。据悉，该产品的底层资产为知识产权融资租赁业务，采用了知识产权二次许可模式，是天津市首单知识产权证券化项目、首单科技租赁业务证券化项目，同时也是全国首单国有企业知识产权资产证券化项目。

Tianjin Issued Its First Intellectual Property Asset-Backed Medium-Term Notes with an Amount of 100 Million Yuan (approx. US$14 million)

The City of Tianjin in Northern China has issued its first IP securitization product, Tianyin Bohua- Binhai New Area Intellectual Property Directional Asset-Backed Medium-term Notes (Science and Innovation Notes, Phase I)", with an issuance amount of CNY 100 million (approx. US$ 14 million). The project was led by the Bank of Tianjin, Intellectual Property Operation, center of Bohai Chemical Industry Group, and Intellectual Wealth, initiated by Jinzhi (China) Financial Leasing Co., Ltd., a leasing enterprise in Tianjin Dongjiang Bonded Port Area supported and guided by Tianjin Finance Bureau, Tianjin Intellectual Property Office and Binhai New Area Intellectual Property Office. It is reported that the underlying asset of this product is the intellectual property financial leasing business, which adopts the secondary licensing mode of intellectual property. It is the first intellectual property securitization project and the first technological leasing business securitization project in Tianjin, as well as the first intellectual property asset-backed securitization project of a state-owned enterprise in China.

日前，国知局编写并公布了《专利开放许可使用费估算指引（试行）》，内容包括总则、估算方法、操作步骤三大部分，目的在于推动专利开放许可制度的平稳落地和高效运行，引导专利权人科学、公允、合理估算专利开放许可使用费，促进市场化定价和许可达成。其中，有关估算方法，《指引（试行）》提出了参考该专利已自行实施产生的收益、参考该专利已许可实施的使用费、参考同行业专利实施许可统计数据、参考国际一般许可费率、资产评估方法等五种专利开放许可使用费估算方法；有关操作步骤，《指引（试行）》提出了判断专利开放许可适当性、根据场景选择估算方法、确定计算基数、设置调整系数、估算使用费并确定支付方式等步骤来估算专利开放许可使用费。《指引（试行）》还附有开放许可使用费估算示例等参考资料。

The Office of CNIPA Issues Guidelines for Estimating Open Patent Licensing Fees (Trial)

Recently, the CNIPA published Guidelines for Estimating Open Patent Licensing Fees (Trial). The Guidelines, which include the following three parts, general principles, estimation methods and operating procedures, aim to promote the smooth implementation and efficient operation of the open patent licensing system which was introduced into China’s patent law in 2021; guide patentees to estimate the open patent licensing fee scientifically, fairly and reasonably; and promote pricing and licensing fees based on market conditions. The Guidelines list several methods for calculating open patent licensing fees: by considering the revenue generated from the patentee’s previous exploitation of the patent; by reference to regular patent licensing royalties in the same industry, and regular international royalty rates and asset evaluation methods.
The Guidelines (Trial) contain operating procedures to help patentees determine whether an open patent license is appropriate and, if it is, the steps they should take to determine the appropriate license fee. The Guidelines (Trial) also contain some helpful reference materials such as examples of estimated open patent licensing fees.
